The Contest runs from the October 6, 2022 to October 27, 2022.  All entries must be received by 11:59 p.m. PT on the October 27, 2022.  Normal Internet access and usage charges imposed by your online service will apply. 

Contestants may submit up to only 2 entries for the Contest. All entries must be original works and must not have been previously submitted in other design contests. Lakai will have sole and exclusive authority in determining whether any entry complies with these rules and regulations.

ELIGIBILITY.

Participants must be over the age of 13 and a US citizen at the time of entry to participate in this Sweepstakes. If the winner is under the age of 18, the winner’s parent or legal guardian must give consent.  The Contest is void where prohibited by law. Employees of Lakai Limited Footwear and its respective affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees’ families.

PRIVACY POLICY AND USE OF DATA.

By participating in the Contest, participants agree to all personal information uses and disclaimers as explained in Lakai Limited Footwear’s privacy policy at https://www.lakai.com/pages/privacy-policy.

By submitting entry/ies in the Contest, the participant agrees and permits Lakai to collect the participant’s email address and phone number for Lakai’s promotional and marketing programs (via email or SMS). The participant may, at any time, unsubscribe from the same. 

SELECTION OF WINNING ENTRY.

3 Winners will be chosen by team rider Vincent Alvarez and announced through social media and on Lakai.com.

The 1st place winner will receive 4 pairs of their very own Lakai Atlantic and a $500 gift card on Lakai.com. Second place will receive a $300 gift card, and Third place will receive a $200 gift card.

SELECTION OF POTENTIAL WINNERS. 

Potential winners will be notified via telephone or e-mail within 30 days of the end of the Contest. Lakai’s decisions as to all matters related to administration of the Contest and selection of winner is final.  The potential winners must comply with all terms and conditions set forth in these Official Rules, and the awarding of prizes are contingent upon fulfilling all requirements.  If a potential winner cannot be contacted within 72 hours after the first attempt to contact such potential winner, then an alternate winner will be selected.  Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.

PRIZES.

The 1st place winner will receive 4 pairs of their very own Lakai Atlantic and a $500 gift card on Lakai.com. Second and Third place will also receive a $500 Lakai.com gift card.. This prize is non-transferrable. Prizes (and/or any portion thereof) are nontransferable and non-exchangeable. Additional restrictions or requirements may apply. 

All federal, state, and local taxes related to the prizes are the sole responsibility of the winner.  All expenses and costs, not expressly included above, are the winner’s sole responsibility.  No refunds or credit for changes are allowed.    

PUBLICITY.

Except where prohibited by law, each winner grants to Lakai, and its designees the right to use and publish such winner’s photo, proper name, likeness, voice, opinions, testimonials, biographical information, town and state of residence, and any photographs or images taken by such winner with equipment provided by Lakai in any media to promote Lakai’s Contest without additional compensation, permission, or notification.

RELEASE.

By entering the Contest, participants agree to release, and indemnity and hold harmless Lakai, their respective subsidiaries, affiliates, directors, officers, employees and agents from and against any and all losses, damages, claims, or causes of actions of any kind arising, in whole or in part, directly or indirectly, out of entrant’s participation in the Contest and/or resulting, directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Contest, including, without limitation, personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.

By entering, each contestant warrants and represents the following with respect to their entry: (a) contestant is the sole and exclusive owner of the entry submitted via e-mail or Instagram post following the tags; (b) the Submission will not infringe on any rights (including, without limitation any intellectual property rights) of any third parties; (c) any third parties appearing in the Submission have given entrant appropriate consent to be photographed and used as permitted herein; and (d) all information the entrant provided herein is true and accurate.

For the winner, submitting an entry constitutes the winner’s consent to give Lakai an irrevocable, exclusive license to use, reproduce, modify, publish, create derivative works from, and display such entries in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, for the legal term of protection of copyright including future legal extensions thereof, including but not limited to on any and all Internet media, including Lakai’s websites and properties and on social networking sites and any Lakai partner retail stores and any Lakai events and exhibitions. By entering, each entrant consents to the Lakai dealing with their entry/ies in any way that may otherwise infringe the entrant’s moral rights and agrees not to assert their moral rights (wherever such rights are recognized) in respect of their entry against Lakai or its assigns, licensees or successors 

LIMITATION OF LIABILITY; DISCLAIMER OF WARRANTIES.

WHEREVER ENFORCEABLE, THIS CONTEST IS NOT SUBJECT TO LEGAL RECOURSE.

WHEREVER ENFORCEABLE, IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE AND/OR ENTRY IN THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE CONTEST. WITHOUT LIMITING THE FOREGOING, THIS CONTEST AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

GENERAL CONDITIONS.

Wherever enforceable, the parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Wherever enforceable, any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Orange County, California before Judicate West.

WHEREVER ENFORCEABLE, THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.

For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California. The parties agree not to raise the defense of forum non conveniens.

All federal, state, and local laws and regulations apply. The Contest is void where prohibited.  

Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry.  The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.  A potential winner may be requested to provide Lakai with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry or is a resident of a permitted jurisdiction.  The prize will only be awarded to the authorized account holders.

If, in Lakai’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, Lakai reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify, or suspend the Contest, in whole or in part, at any time without notice.  In the event of such cancellation, Lakai reserves the right to award prizes in a random drawing from all eligible entries received before the time of cancellation.  Lakai also reserves the right to cancel or modify the Contest if fraud or any other factor impairs the integrity of the Contest as determined by Lakai in its sole discretion.

Lakai assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alternation of, entries. Lakai is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Lakai on account of technical problems or traffic congestion on the Internet or at any web site, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Contest.
